Law 203 – Introduction to Moot Court Competition: Special Topics


The course is intented to improve the legal writing and oral skills of students who will participate in any Moot Court Competition, national or international. Instruction and guidance on legal research methods, how to prepare and organize a legal memorandum, litigation and advocacy strategies and improvement of oral presentation skills will be given.

Law 323 – International Sales Law


Bu dersin amacı, 1988 yılında yürürlüğe giren ve bugün yetmişten fazla ülkenin taraf olduğu Milletlerarası Mal Satımına İlişkin Sözleşmeler Hakkında Birleşmiş Milletler Antlaşması (CISG) esas alınarak sınır aşan satım sözleşmelerinin tabi olduğu kuralların Türk satım hukuku ile karşılaştırmalı olarak incelenmesidir. Bu bağlamda, bir satım sözleşmesine ne zaman CISG kurallarının uygulanacağı, CISG kuralları ile ulusal satım hukuku kuralları arasındaki hiyerarşi, CISG uyarınca satım sözleşmesinin kurulması, satıcı ve alıcının yükümlülükleri ve bu yükümlülüklerini ihlal etmelerine bağlanan yaptırımlar ve sorumluluk rejimi ele alınacaktır. Hem Kara Avrupa’sı hem de Anglo-Amerikan hukuk sisteminin etkilerini taşıyan CISG’ın incelenmesi sürecinde, aynı zamanda bu iki hukuk sisteminin sözleşme hukukuna ilişkin temel ilkeleri de mukayeseli olarak öğrencilere aktarılacaktır. Derste başarılı olan öğrencilerden oluşturulacak bir grup Üniversite’yi temsilen “The Annual Willem C. Vis International Commercial Arbitration Moot” yarışmasına katılacaktır.

Law 418 – International Trade Law


This course aims at exploring both the private law and the public law issues applicable to international trade relations. The first and public law part of the course will focus on the main treaties regulating international trade as embodied in the General Agreement on Tariffs and Trade and the World Trade Organization, as well as regional trade entities such as the European Union and the North American Free Trade Agreement. This part will examine the law applicable to tariff and non-tariff barriers, discrimination, regionalism, anti-dumping duties, countervailing duties, safeguard measures and the devices for international settlement of trade disputes. The second and private law part will deal with the key rules in international commercial transactions. To achieve this aim, the course will cover the fundamental characteristics of international sales of goods and essential contracts for the financing of trading activities, transportation of goods to their place of destination, settlement of disputes, and methods of payment in international commercial transactions.

Law 503 – International Commercial Arbitration


International arbitration is the common dispute resolution method in international commerce. Since 2001, the Turkish International Arbitration Act has governed the international arbitrations taking place in Turkey. This course covers the process of international arbitration under the Turkish International Arbitration Act.

Law 506 – International Commercial Law


The course covers primarily the conclusion of international contracts, applicable law, delivery of goods, international payment methods, commercial letters of credit, international finance, international construction law, dispute resolution and international jurisdiction.
